The probate process is a legal process of administering the estate of someone who has died (the decedent.)  Probate is not always necessary and can be avoided by planning appropriately.  Probate may be necessary where there are significant assets in the estate, where a Will is in question, or where there is no Will and there are multiple people who may inherit property from the estate.  A less formal process may be used for a small estate one less than $100,000.  The probate process takes a minimum of six months and the small estate process takes a minimum of three months.
